Special Terms and Conditions for the Hire of Function Venue and the Kitchen

1 If you have agreed with us to dry hire a function room or the Kitchen for a private Function, then this clause will apply.
2 You agree that all of the food is to be supplied by you or by contractors for your Function.
3 You agree that all of the food to be supplied by you  or by contractors for your Function is not to be supplied for a fee or profit or as part of or in furtherance of a business.
4 You warrant to us that at all times the food supplied by you or by contractors for your Function is and will be safe for human consumption and use.
5 You agree that we will not supply food or food items for your Function and that we are not responsible in any way for the supply or serving of any food or food items by or for you at your Function.
6 You agree to pay for any agreed  labour costs if incurred by us to provide personnel to provide security to ensure that no damage or misuse occurs to the Kitchen, any equipment, any goods or stock in the Kitchen at any time before, during or after your Function.
7 You agree to be liable for all costs of cleaning up the Kitchen and any equipment, goods or stock in the Kitchen arising from your hire or use of the Kitchen or any equipment or goods in the Kitchen in connection with your Function.
8 You agree to be liable for any damage, loss or repairs to the Kitchen, any equipment, goods or stock in the kitchen or the Megalong  Premises for or in connection with or arising out of any use, misuse of the Kitchen, or any use, misuse or loss of any equipment, goods or stock in the Kitchen or the Megalong  Premises by or for you or by any person assisting you, working for you, employed or contracted by you or attending your Function.
.9 You agree that you will be solely responsible to with the supply of food or food items by or for you at your Function.
10 You agree that our food licences are not being used or to be used and do not cover the supply of any food or food items at your Function as no food or food items are being supplied by us for your Function.
11 You agree that you will be solely responsible to obtain, hold and maintain adequate and sufficient insurance to cover the holding of your Function at the Megalong  Premises and to cover the supply of food or food items by or for you at your Function.
12 You agree that we will not be providing any food ingredients, food items or any assistance with the preparation, supervision of the preparation, catering, distribution or serving of any food or food items supplied by you at your Function except as agreed in writing with you.
13 You agree that we are not responsible in any way whatsoever to any person for or in connection with the supply of any food or food items by or for you at your Function.
14 You agree that any assistance or staffing supplied by us in connection with the preparation, heating or serving of any food items prepared by or for you is done on a labour hire charge only on your behalf and as your agent for you.
15 You agree to indemnify us and our officers, employees and shareholders from any claim, liability, loss, damage or expense incurred or suffered by us, our officers, employees or shareholders for or in connection with: (a) the supply by or for you of any food or food items at your Function; (b) any death, injury or illness caused to any person due to the supply by or for you of any food or food items or the supply of any food or food items that are unsafe, unhealthy or that may cause any person any illness, sickness, food poisoning or harm; and (c) any other act or omission or wilful damage or neglect caused by or on behalf of you or any other person working for or contracted or subcontracted to you.

2 Service Providers

2.1 We accept no responsibility or liability for any service provider engaged, retained or used by or for you. You are solely liable to pay for your service providers.
2.2 You must ensure that all service providers comply with our guidelines and directions for noise levels, access, set up and general conduct and behaviour whilst in, on or about the Megalong  Premises.
2.3 We will not be liable for any loss or damage caused or suffered to any person or any property, which is due to, or contributed to by the negligence, acts or omissions of any service provider.
2.4 You agree to indemnify us in respect of any loss or damage caused by any service provider engaged, retained or used by or for you at any time.

2.5 We do not have to control or supervise any of the service providers engaged, retained or used by or for you.

2.6 Contract Performance & Disclaimer

2.7 We will not be liable for any non-performance of any of our obligations under this agreement if our non-performance is caused or contributed to by riot, fire, flood, storm, electricity or gas disruption, industrial dispute, terrorist acts, acts of God, government regulations and other force majeure events or any other reason beyond our control.
2.8 We will use our reasonable efforts to relocate your Function to another function room or area on the Megalong   Premises if possible and you must accept such substitution without compensation.
2.9 If it is not possible to relocate your Function to another room or area, reasonable efforts will be made by us to relocate your Function to a suitable venue but we are not liable for any delays or additional costs incurred by you due to or as a result of the relocation of your Function.
2.10 You agree to indemnify us from and against any action, claim or demand whatsoever which arises or may arise as a result of a function at the Megalong   Premises which has been organised by you.
2.11 Where matters beyond our control impair or prevent us from performing any of our obligations under a confirmed booking, you agree to release us from all liabilities.

Hours for hire

Access is permitted to the venue between the hours of 8am and  5pm .  This time is to allow for set up and break down of your event within these timings.  Access is not permitted overnight . Your event must conclude by 11pm.

Music

Dance the day or night away with your band, DJ or IPOD.. Amplified sound is permitted between 10am and 10pm, Monday to Thursday and Sundays. On Friday and Saturday, amplified sound (DJ or IPod) may be approved until 11pm, with any live amplified music (band) concluding by 10pm. Marriage Celebrants are permitted the operation of a portable, battery operated P.A. system.

Fees, Payment and Cancellation

Hire Fee inludes gst.   The fee includes  day either side of your event day to set up and break down. Once you confirm, 20% of the total fee is payable, the outstanding amount is due 2 weeks prior. If a cancellation occurs, any fees that have already been paid are non-refundable.

What does the fee include?

To create your unique event we allow you half a  day access to our venue. You will need this time to allow for set up (bump in), hosting your  event and breaking down the set up afterwards (bump out).  You will also be able to access available power and water in the venue.

There will be a charge for staff member to assist you with any labour over the three days.

Venue Manager.

We provide a venue supervisor for each function.  The  supervisor will assist you in all matters in relation to the event  and the cost is per hour. The venue supervisor will be onsite for the full period of the hire, from the beginning of the bump in until the bump out  and the until the guests and hirers leave the premises.

The venue supervisor's role does not include waiting on guests, stage managing or providing security.

Cleaning

The venue will be cleaned before your event and must be left clean and tidy with all furniture, equipment, decorations and rubbish including bottles, removed prior to final  bump out.

Please ensure you have booked enough event staff to provide service to your guests. Clearing up at the end of the event must be undertaken. No bottles or rubbish is to remain  within the hired area. If venue staff are required to clean they will be charged to the hirers account.

All waste must be removed from the venue at hirers cost.

Furniture and Equipment

We can provide a range of suitable furniture to hire for your special event. such as table ware, props, as well as  ceremony sites.

Smoking

Smoking is not permitted in the  main  or outbuildings

Conduct of Persons Attending Functions

The hirer will be held responsible for the conduct of persons attending the function and should damage be caused by any person during the function, the cost of repairs or replacement will be made a charge against the hirer. Where the hirer has not exercised reasonable control over the persons attending the function, the function will be terminated.
